Futile litigation and attorney liability

Jakob Widner discusses in his current ILO-article a decision of the Austrian Supreme Court regarding futile litigation and attorney liability. The Supreme Court recently had to decide whether a lawyer is liable for damages if, after examining the factual and legal circumstances, he rejects to persue a claim for the client because he considers it to be futile.
