Different panels, different opinions – different decisions

Contradicting assessments of the issue of likelihood of confusion regarding the same trademarks by different panels of the same appellate court in parallel conducted opposition and infringement proceedings do generally not justify an extra-ordinary appeal to the Supreme Court notwithstanding that one decision only can be correct.
