In her latest article, Claudia Csáky highlights the legal risks associated with participating in “shitstorms”. A case recently decided by the Supreme Court clarifies that, in principle, any person who participates in the dissemination of untrue allegations about a third party in social media is liable for the entire damage to the victim and must then seek recourse against the co-participants themselves. The risk that the co-participants are not identified or are unable to bear a share of the damage due to a lack of financial resources is borne by those involved in the shitstorm and not the victim.
